Liability for Inadequate Internet Data Security:
Invasion of Privacy, Identity Theft, Unauthorized Medical Record Release

When data is hacked, wrongfully conveyed or destroyed, the scope of liability for the damages is often large.

The cost of the cyberattacks in U.S. companies, government agencies, banks and universities has reached $377 million annually according to a recent Computer Security Institute (CSI) survey.

Given the massive increase in use of the internet for e-business, the need for adequate database security is essential. However, recently there have been a number of cases of inadequate digital security resulting in privacy breaches. These instances include credit card fraud, identity theft, inappropriate medical record release onto the net as well as on-line theft. Recently, there was a $4 million verdict in a case against Trans Union Credit under the Fair Credit Reporting Act. Cousins v. Trans Union. In addition, AOL was hit with a privacy action which it settled for significant sums for revealing the name of a man who posted a message on line that he was gay. AOL gave his name to a Navy investigator posing a a civilian. This violated the Electronic Communications Privacy Act. Last month an ISP was held criminally responsible for releasing child porn after it was notified of it and failed to remove the data. There is also a case pending against a law firm for illegally obtaining credit reports, bank account data and medical records via the internet through the use of private investigators. Negligent data security cases will result in a wave of litigation.
